US Health Data & HIPAA Notice
1. Does HIPAA currently apply?
Under its current direct-to-consumer model, Cute Meals is not a health plan, clearinghouse or HIPAA covered provider and does not claim that the service is HIPAA compliant. A consumer independently downloading the app does not alone make Cute Meals a HIPAA business associate.
2. When could HIPAA apply?
HIPAA and a Business Associate Agreement may become relevant if Cute Meals creates, receives, maintains or transmits protected health information for a US clinic, provider, hospital, health plan or their business associate.
3. Other US rules
Even when HIPAA does not apply, the FTC Act, FTC Health Breach Notification Rule, COPPA and state consumer-health privacy laws may apply. Cute Meals does not sell health data for advertising or build targeted-advertising profiles from it. Required breach notices will be made to affected users and authorities.
4. Children and COPPA
Cute Meals is directed to parents and adult caregivers, not to children under 13 opening accounts or using the service independently. Direct child use would require a separate age, parental notice and verifiable parental-consent programme.
